2. The petitioner apprehends his arrest in a case registered for offence under Section 392 of the Indian Penal Code.

3. As per prosecution case, while the informant after closing his shop was going on motorcycle along with two persons, on the way, four miscreants boarded on two motorcycle, arrived there and pushed his motorcycle and on the point of gun looted cash of Rs. one lakh, two mobiles, 50 gram gold and key of the shop.

4. Name of the petitioner transpired during course of investigation. No incriminating article has been recovered from the possession of this petitioner. Petitioner is a poor labourer and works in Gujarat for his livelihood and has got no concern with the alleged occurrence.

5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that name of the petitioner transpired during course of investigation and he has got three criminal antecedents of similar nature.

6. Considering the nature of accusation and criminal antecedent, the prayer for anticipatory bail of petitioner is rejected.
