1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Basopatti P.S. Case no. 42 of 2024 registered under sections 272, 273, 414 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, a total of 330 liters of illicit liquor from the four motorcycles was recovered and the petitioner was taken into custody. From the motorcycle on which the petitioner was present, it is stated that 90 liters of liquor was recovered.
4. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner. He is neither the owner of the
Patna High Court CR. MISC. No.39842 of 2024(2) dt.04-06-2024 2/2 motorcycle in question nor has he concern with the seized liquor. He is in custody since 19.3.2024 and has no criminal antecedent.
5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner not having any criminal antecedent and having remained in custody since 19.3.2024, the Court directs the petitioner to be enlarged on bail in connection with Basopatti P.S. Case no. 42 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani.
