JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Rajpur P.S. Case No. 62 of 2019 for the offenses under Sections 147, 148, 149, 341, 323, 307, 427, 379, 436, 337, 353, 504of the Indian Penal Code.
Learned counsel for the petitioner submits that prior to the instant case there was no criminal antecedent against the petitioner. It is alleged that after the road accident injured were taken to hospital but the injured were referred to higher hospital for better treatment. In the meanwhile injured died which led to protest and the mob damaged the Hospital. In the protest along with petitioner approximately 40 persons have been named as accused. There is general and omnibus allegation against all the
Patna High Court CR. MISC. No.33833 of 2019(2) dt.27-05-2019 2/2 accused persons including the petitioner. Similarly circumstanced other accused have been granted bail. Considering the fact that the petitioner has no criminal antecedent prior to the instant case and similarly circumstanced others have been granted bail, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Rajpur P.S.
