Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Sursand P.S. Case No. 195 of 2019 registered for offence punishable under Sections 341, 323, 324, 379, 307, 504/34 of the Indian Penal Code.
As per the allegation, the FIR named accused persons assaulted the informant. There is specific allegation against co-
Patna High Court CR. MISC. No.45327 of 2021(2) dt.13-04-2022 2/3 accused Md. Sakir that he inflicted axe blow on the head of the informant and petitioner no. 2 inflicted knife blow on him. The allegation against petitioner no. 3 is that he took away Rs. 1100/- from him.
Learned counsel for the petitioners has submitted that both the parties are agnates and there is land dispute between the parties. He has also submitted that there is no specific allegation of inflicting assault against petitioner nos. 1 and 3. The allegation of assaulting knife blows on the informant is against petitioner no. 2 but the injury is lacerated wound and it was opined as simple in nature. He has submitted further that the petitioners are the persons of clean antecedents. Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 195 of 2019, subject to condition as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove,
