Petitioner is not named in the first information report but in course of investigation, he was arrested and confessed his guilt and thereafter, one Herohonda motorcycle bearing registration no. BR 46C/9089 was recovered from the house of father-in-law of petitioner. The contention on behalf of the petitioner is that the aforesaid seized motorcycle belongs to the petitioner which is evident from annexure 4 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Jamui in Jhajha P.S.
