No doubt, petitioner is named in the first information report but admittedly, none has seen actual killing of deceased persons of this case and the petitioner has been made accused in this case on mere suspicion as land dispute was going on between family members of the petitioner as well as deceased persons.
In course of investigation, the tower location of mobile was collected and it was detected that tower location of the petitioner was in his village on the alleged date of occurrence and after that; his tower location was found in Orissa. Furthermore, it
Patna High Court Cr.Misc. No.37428 of 2015 (3) dt.05-11-2015 2/2 was also found that the information in respect of missing of mobile phone of petitioner was filed to the concerned police station. It appears that except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody for more than one year.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jogbani (Bathnaha) P.S. Case No. 70 of 2014 to the satisfaction of Additional Chief Judicial Magistrate, Araria. (Hemant Kumar Srivastava, J) A.K.V./- U T
