The petitioner is languishing in custody since 12.10.2014 in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act.
On information that the miscreants are preparing to commit dacoity, raid was laid, when the petitioner and others were apprehended. From the possession of the petitioner one loaded country made pistol, cartridge, two mobiles, voter I.D. and driving license were recovered. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.22734 of 2015 (2) dt.10-07-2015 2/2 petitioner that the investigation has already concluded. Considering the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dalsingsarai, District - Samastipur in connection with Dalsingsarai P.S. Case No. 485 of 2014.
Since the petitioner is accused in three other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
