The petitioner seeks regular bail in connection with Buxar (T) P.S. Case No. 331 of 2019 for the offences punishable under Sections 30(a) of the Bihar Excise Act (Amendment) Act, 2018.

The allegation as per the written report of the informant is that when the police personnel posted on Golambar check-post were checking vehicles, they had apprehended one tempo, which was coming from U.P., and on search huge quantity of English illicit liquor was recovered and the accused persons were caught while fleeing away.

The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and is languishing in

Patna High Court CR. MISC. No.33455 of 2019(4) dt.17-08-2019 2/2 custody since 14.04.2019. It is further submitted that though the allegation is regarding recovery of 1036 bottles of illicit liquor, but each bottle is said to be containing 180 ML of illicit liquor. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge Excise Act, Buxar in connection with Buxar (T) P.S. Case No. 331 of 2019.
