The petitioner apprehends his arrest in a case registered for the offence under Section 30(c) of Bihar Prohibition and Excise Act.

225 kg. of Mahua flowers has been recovered, which was loaded on a bullock cart near the village Baksauti. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the alleged bullock cart and he has been made accused only on the basis of confessional statement of apprehended co-accused Raju Yadav. Petitioner has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.35056 of 2022(2) dt.09-09-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court no. 2, Gaya in connection with Sherghati P.S. Case No. 144 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
