====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 26-05-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Manjhagarh P.S. Case No. 228 of 2023, registered for the offences punishable under Sections 341, 323, 324, 325, 307, 354, 504 and 34 of the Indian Penal Code. Petitioner has one criminal antecedent.

3. As per the F.I.R., there is specific allegation against the petitioner to have assaulted the informant and his family members and other co-accused persons are also alleged to have assaulted the family members and even tried to outrage the modesty of the lady members.

4. The learned counsel for the petitioner submits that

2/4 petitioner is innocent and has falsely been implicated in this case only because of the fact that he happens to be an army personnel. It has further been submitted that there is case and counter case between the parties and similarly situated coaccused person has been enlarged on bail from the learned Court below itself. It has also been submitted that one Rana Singh, a co-accused has been granted bail with similar nature of allegation as that of the petitioner and the chargesheet has been submitted in the present case. Lastly, it has been submitted that though the petitioner was named in a chargesheet of one Manjhagarh P.S. Case No. 24 of 2016, however, he has no other case against him and in the present he is in custody since 21.04.2025.

5. Learned A.P.P. for the State has opposed the prayer for bail and has stated that there is specific allegation upon the petitioner to have assaulted the lady members of the informant's side, causing injuries and hence he does not deserve the liberty of bail.

6. Considering the aforesaid submissions made by the respective parties and taking into account that similarly situated co-accused person has been granted bail, I am inclined to grant the petitioner privilege of regular bail.

7. Accordingly, the prayer for bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned C.J.M., Gopalganj, in connection with Manjhagarh P.S. Case 228 of 2023, subject to the following conditions:- (i) One of the bailors of the petitioner shall be his close relative.

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned Trial Court.

(iii) In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be canceled by the Court concerned. (iv) If the petitioner is found involved in similar nature of offence in the future, the prosecution will be at liberty to move for cancellation of his bail bonds.

(v) The learned Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the

4/4 above-mentioned order shall not be delayed for purpose of or in the name of verification.
