2. The present writ petition has been filed for a direction to the respondents not to issue a license of PDS dealership to respondent no. 6.

3. Learned counsel for the petitioner submits that in the merit list the petitioner's name appeared at serial no. 1 with 972 marks (Annexure-2) whereas in the counselling, the name of respondent no. 6 has been shown at serial no. 1 but the petitioner's name does not find place in the said list at all. It is submitted that the petitioner has raised objections by way of filing representations

Patna High Court CWJC No.10535 of 2019 dt.10-06-2019 2/2 before the District Magistrate, Banka on 04.02.2019 (Annexure-3) and again on 15.02.2019 (Annexure 3/A) which however remained pending. It is submitted that it will suffice if the petitioner's representations dated 04.02.2019 (Annexure-3) and 15.02.2010 (Annexure-3/A) filed before the District Magistrate, Banka (Respondent No. 3) are directed to be disposed of, in which event, the present writ petition need not be pressed on merits.

4. Learned counsel for the respondents appears and has been heard.

Having regard to the nature of the grievances and the stand of the petitioners, the present writ petition is disposed of with a direction to the District Magistrate, Banka (Respondent No. 3) to consider and dispose of the petitioner's representations dated 04.02.2019 (Annexure-3) and 15.02.2010 (Annexure-3/A), if the same are still pending before him, after grant of opportunity of hearing to the petitioner in accordance with law expeditiously and preferably within a period of eight weeks from the date of receipt/production of a copy of this judgment.
