JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is said to have given Bhujali blow to the informant as well as his son, causing injuries on neck of both the above-said injured but submission on behalf of the petitioner is that no injury on the neck of the informant was found and the informant sustained simple injury, though said to be caused by sharp cutting weapon and so far as injury of informant's son is concerned; only one injury was found on his neck and opinion, regarding the nature of aforesaid injury was kept reserved but till date, no opinion regarding the aforesaid injury was given by the doctor. It is further contended by him that the petitioner is in jail custody

Patna High Court Cr.Misc. No.32919 of 2015 (3) dt.26-08-2015 2/2 since 01-06-2015 and according to prosecution case itself, the alleged occurrence took place on account of land dispute.

Considering the facts and circumstances of the case and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulwaria P.S. Case No. 47 of 2014 to the satisfaction of Sri S. Ranjan, J.M. Ist Class, Gopalganj.
