2. The petitioner seeks bail in connection with Belaganj P.S. Case No. 203/2020 registered for the offences under Sections 147, 149, 341, 323, 307 and 302 of the Indian Penal Code.
3. As per the prosecution case, the informant has alleged that his son, who was playing cricket along with other children on 05.07.2022, entered into a scuffle resulting in assault by Vikas Kumar with bat and Amarnath, Raushan Kumar, Jayant Kumar also assaulted him by bat and wicket resulting in severe injuries to the son of the informant and during the course of treatment, he died.
4. Learned counsel for the petitioner submits that

No.35746 of 2025(2) dt.29-05-2025 2/3 petitioner is innocent and has falsely been implicated in this case and even if the allegations are taken on face value, there is allegation upon the petitioner to have assaulted the son of the informant with slap and fist. Learned counsel further submits that there is no specific allegation on the petitioner of assaulting the son of the informant with any hard and blunt substance. It is lastly submitted that the petitioner has clean antecedent and is in custody since 11.04.2025.
5. Learned APP for the State has opposed the prayer for bail of the petitioner and submits that the petitioner along with other students, assaulted the informant's son which caused him grievous injury and he died, during the treatment.

Considering the aforesaid facts and circumstances of the case and taking into account that there is no specific allegation on the petitioner of assaulting the son of the informant with any hard and blunt substance and further taking into consideration that the petitioner has clean antecedent, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 203/2020 subject to the conditions :-
Patna High Court CR. MISC. No.35746 of 2025(2) dt.29-05-2025 3/3 a. One of the bailors of the petitioner shall be his close relative.
b. The petitioner shall remain physically present in Court on each date of the trial.
c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to the cancelled by the court concerned.
d. The Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the aforementioned order shall not be delayed for purpose of or in the name of verification.
