====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-12-2020 Heard Dr. Manoj Kumar, learned counsel for the petitioner and Smt. Nirmala Kumari, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Sanhaulla P.S. Case No. 137 of 2019 registered for the offence punishable under Section 393 of the Indian Penal Code 1860.

The allegation as per the First Information Report is that the petitioner along with another person arrived at the shop of the informant and demanded cash and when the grandson of the informant who was present in the shop, raised alarm, the accused persons fled away on the black

No.32733 of 2020(2) dt.07-12-2020 2/3 colour Motorcycle without registration number and upon chase, the petitioner and another accused persons left the Motorcycle in front of Fakir Tola Anganbari Centre Sanhaulla. The petitioner has been arrested on the basis of Motorcycle which was recovered from near Anganbari Centre Sanhaulla.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated in this case on the basis of the fact that Motorcycle belongs to the petitioner. Learned counsel further submits that petitioner is in custody since 15.01.2020.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner has got no criminal antecedent, I am inclined to grant regular bail to the petitioner on completion of one year in custody.

Accordingly, let the petitioner, above named, be released on regular bail, after completion of one year in custody, on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to
