The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusations are of torture and making assault for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. It is further submitted that after

Patna High Court CR. MISC. No.37121 of 2022(2) dt.30-11-2022 2/3 few months of the marriage, some trouble cropped up in the tongue of the petitioner which was diagnosed as primary stage of cancer. The operation of the tongue of the petitioner was conducted on 28.04.2020 and thereafter the attitude of the informant changed and she started pressurizing the family to send her to her maike. The petitioner is still ready to keep the informant as wife with full dignity and honour. A statement to that effect has been made in para 16 of the petition.

Learned counsel appearing on behalf of the informant has submitted that torture was inflicted upon the informant for non-fulfillment of dowry demand. However, he does not controvert this fact that petitioner has been diagnosed for cancer.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

No.37121 of 2022(2) dt.30-11-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan in connection with Mahila(Siwan) P.S. Case No. 12 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
