2. This is the third attempt of the petitioner for grant of regular bail in connection with Sessions Trial No. 116 of 2023 arising out of Barahiya P.S. Case No. 261 of 2022 registered for the offence under Sections 302, 120(B), 34, 506 and 379 of the Indian Penal Code.

3. The petitioner is one of the assailants of the deceased and six injuries have been found on the deceased.

4. The petitioner is in jail since 29.11.2022 and out of seven witnesses, four witnesses have been examined.

5. Learned counsel for the informant submits that the prosecution is examining the witnesses and the delay has not been caused by the prosecution.

6. In view of the aforesaid submission of the learned counsel for the Informant, this application is dismissed with a direction to the Superintendent of Police, Lakhisarai to ensure the attendance of the witnesses in the trial.

7. Let a copy of this order be communicated to the Superintendent of Police, Lakhisarai through FAX for its compliance.

8. If the trial is delayed by the prosecution then the petitioner may renew his prayer for bail.
