JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-08-2019 Learned counsel for the petitioner is permitted to implead District Programme Officer (Establishment), Saran at Chapra during the course of the day.

The present application involves inter se seniority of the petitioner and respondent no.5 and posting of the senior most teacher as In-charge Headmaster in the school. Although, there is no post of In-charge Headmaster, it is only a alternative arrangement until regular Headmaster is posted in the school. Considering the aforesaid, the writ petition is disposed of with a direction to the District Programme Officer

Patna High Court CWJC No.10902 of 2019(3) dt.27-08-2019 2/2 (Establishment), Saran at Chapra who shall determine the inter se seniority of the petitioner and respondent no.5 at the earliest preferably within a period of one month from the date of receipt/production of a copy of this order and thereafter post the senior most teacher as In-charge Headmaster until regular Headmaster is posted in the school.

Necessary decision in this regard may be taken by the respondents within a period of sixty days from the date of receipt/production of a copy of this order.

It goes without saying that respondents after examining the claim of the petitioner take steps for payment of salary, if there is no impediment in granting salary of the petitioner.

Necessary decision granting salary may be taken by the respondents within a period of 30 days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
