The petitioners are apprehending their arrest in a case

Patna High Court CR. MISC. No.33104 of 2020(2) dt.23-02-2021 2/3 for the offence registered under Sections 341, 323, 354, 354(B) and 504/34 of the I.P.C.

The prosecution story, in brief, is that the petitioners assaulted and outrage the modesty of the informant. It has been submitted by learned counsel for the petitioners that the petitioner no. 2 has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. Due to previous enmity, the present case has been instituted. The date of occurrence is said to be 02.09.2019 and the case was instituted on 26.10.2019. Delay has not been explained by the prosecution. The prosecution has not come with clean hands. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Darbhanga, in connection with
