The petitioner has prayed for bail in a case registered for the offence punishable under sections 232, 419, 420, 489(a) (b)(c)(d) and 34 of the Indian Penal Code.

As per allegation in the FIR, police got secret information about counterfeited notes being carried by some accused persons. Acting on a tip off, police party proceeded at the place of occurrence and apprehended two accused persons including the petitioner. On search, an amount of Rs. two hundred and 40 piece of blank paper of the size of Rs. 100 were recovered from possession of the petitioner It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The

Patna High Court CR. MISC. No.35560 of 2023(2) dt.03-07-2023 2/2 recovery of blank paper does not constitute any offence. No incriminating article has been recovered from possession of the petitioner. Petitioner has got no criminal antecedent and languishing in judicial custody since 23.03.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Sakri P.S.
