2. The petitioner seeks regular bail in connection with Wazirganj P.S. Case No. 67/2025, lodged on 14.02.2025 under Sections 126, 115(2), 109, 303(2), 352, 351(2) and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the F.I.R. has been lodged against four named accused persons, including the present petitioner. It is alleged that a friend of the petitioner, who was travelling in a bus, informed the petitioner and others over the phone, upon which they intercepted the bus. The petitioner and his associates allegedly boarded the bus while armed, pointed a desi katta at the driver, and committed robbery. They are further accused of assaulting both the driver and one of

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is contended that there is no specific or direct allegation against the petitioner, and his name has been maliciously inserted at the instance of the bus owner and staff. It is further submitted that although the petitioner is an accused in another case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, he is in custody since 10.02.2025. The petitioner is willing to abide by all conditions that may be imposed upon him by this Hon'ble Court in the event of his release on bail.

5. Learned counsel for the State opposes the prayer for bail and submits that, from the contents of the F.I.R., it is evident that the petitioner was part of the mob involved in committing robbery in a running bus.

6. In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Wazirganj P.S. Case No. 67/2025, pending before the learned J.M.-1st Class, Gaya is hereby

8. However, the trial Court is directed to release the petitioner on bail by imposing its own condition so that the petitioner may not evade appearance during trial, if he renews his prayer for bail after framing of charge.
