JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 28.01.2015 on the accusation that he was caught red handed while assembled along with others for making preparation to commit dacoity and on being searched, one country made loaded pistol was recovered from his conscious possession. It appears that prior to institution of this case, only one case had been registered against the petitioner and except that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.33445 of 2015 (3) dt.26-08-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna City/concerned court in connection with Fatuha P.S. Case No. 43 of 2015.
