Petitioner apprehends his arrest in Dawath P.S. Case No.145 of 2017, registered under Sections 307, 325 and other minor sections of the Indian Penal Code and 27 of the Arms Act. The informant, Luv Kush Pandey named eleven persons including the petitioner, Dhurahu Pandey @ Idan Pandey @ Idan and alleged that they all indiscriminately assaulted the informant and his brother. The accused persons also made firing causing injury to Luv Pandey, the brother of the informant. Learned counsel for the petitioner submits that Luv Pandey got three fire arm injuries and the informant got one injury which is pain and swelling in back. The police after investigation submitted final form finding the case false against the petitioner and the case was found true against other ten accused persons.

Patna High Court CR. MISC. No.37980 of 2019(2) dt.21-06-2019 2/2 Basant Pandey, Sant Pandey and Murari @ Murari Pandey @ Murali Pandey were granted regular bail by order passed in Cr. Misc. No.9971 of 2018. Bimalesh Pandey, Banarsi Pandey, Janardan Pandey, Mangalesh Pandey @ Mangalesh Dutt Pandey, Mangaru Pandey, Ramashankar Pandey and Sita Ram Bhar were granted anticipatory bail by order dated 09.04.218, passed in Cr. Misc. No.13621 of 2018.

Taking into consideration the facts that the persons against whom the police found the case true have already been granted either regular or anticipatory bail but the police did not find the case true against the petitioner and there is no specific allegation against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj in connection with Dawath P.S. Case No.145 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
