The petitioner apprehends his arrest in Shekhopur Sarai P.S. Case No. 19/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that he got information that a boy is lying unconscious and a motorcycle bearing registration no. BR0CM-4005 was standing there which transpired that the motorcycle belongs to the petitioner Bivekanand. Learned counsel for the petitioner submits that the injured was also going on motorcycle and he dashed the motorcycle of the petitioner from behind and got injured. The injured was taken to the hospital for treatment thereafter referred to P.M.C.H. It is submitted that the petitioner also filed a

Patna High Court Cr.Misc. No.23804 of 2016 (4) dt.04-08-2016 2/2 complaint case for the accident. Petitioner stated that he is the covillager and independent witness has also stated that the injured dashed motorcycle of the petitioner.

It appears that the injured got serious injury and he is still unconscious. It was the petitioner who caused injury to the petitioner and fled away from the place of occurrence. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
