Petitioner seeks bail in Patrakarnagar P.S. Case no. 280 of 2020 registered under sections 3, 4, 5 of the Immoral Trafficking Act and section 30 (a) of the Bihar Prohibition and Excise Act.
Informant got information about running of brothel in House no. E-53 of one Birendra Prasad situated opposite to Bank of Baroda, Vijay Nagar. On raid both petitioners and two ladies were apprehended from the rental room of petitioners. Ladies disclosed that petitioners managed to bring customers. It is submitted that FIR was lodged on 17.05.2020 but petitioners were remanded to police custody after more than 24
Patna High Court CR. MISC. No.33303 of 2020(2) dt.14-12-2020 2/2 hours from the time of institution of the FIR. FIR was sent to the court on 19.05.2020. Both ladies are major. No offence under sections 4, 5 of the Immoral Trafficking Act is made out. Considering the nature of the allegation made against the petitioners and they have already remained in jail for seven months, petitioners above named are directed to be released on bail on furnishing bail bonds of Rs 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in Patrakarnagar P.S. Case no. 280 of 2020.
