JUSTICE SATYAVRAT VERMA ORAL ORDER 05-01-2022 The learned counsel for the petitioner is permitted to make rectification in the prayer portion of the bail petition within two weeks after the Court starts physical mode. Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Benipatti P. S. Case No.159 of 2018, instituted for the offences under Sections 420, 467, 468/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 07.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of interpolation made in the

Patna High Court CR. MISC. No.45391 of 2021(2) dt.05-01-2022 2/2 measurement book no.362 relating to Balwa Ghat Baraj Yojna. The learned counsel for the petitioner submits that petitioner is a government servant and is an engineer and inadvertently said mistake was committed, for which a departmental proceeding has also been initiated. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 07.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case and is being proceeded departmentally, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Benipatti, Madhubani in connection with Benipatti P. S. Case No.159 of 2018. The application stands allowed.
