2. The petitioner apprehends his arrest in connection with Khagaria (Muffasil) P.S. Case No. 703 of 2021 for the offence registered under Sections 341, 323, 324, 307, 379, 354, 504 and 506/34 of the Indian Penal Code.
3. Learned counsel for the petitioner has antecedent of one case and is a women and the informant alleges that on 05.09.2021 in the morning when he was constructing wall of his house, the accused persons including the petitioner along with other accused persons started digging the ditch near the wall of the informant and also started quarreling with him, it is next alleged that on 06.09.2021 at about 7:00 A.M. all the accused persons including the petitioner started digging near the wall on

No.40755 of 2024(2) dt.02-09-2024 2/3 which the informant objected and thereafter, all the accused persons assaulted Chandragupta Maurya, Rajiv Ranjan and the informant, further Chandragupta Maurya sustained injury on his head while Rajiv Ranjan sustained grievous injury on his head and the informant also sustained injury on his hand, leg and waist. Thereafter, it is alleged that the accused persons assaulted Saroj Suwasini and snatched a gold chain.
4. Learned counsel for the petitioner further submits that the petitioner has falsely been implicated in the instant case. It is next submitted that there is no specific allegation of assault against the petitioner. It is next submitted that Shiv Shankar Verma along with Gunjan Verma approached this Court for seeking anticipatory bail by filing Cr. Misc. No. 5270 of 2022 and the same was allowed by an order dated 01.09.2022. It is also submitted that the case of the petitioner is similar to the case of Shiv Shankar Verma and Gunjan Verma.
5. Learned APP appearing on behalf of the State opposes the prayer for bail.
6. Considering the submissions made by the learned counsel appearing on behalf of the petitioners, let the petitioner, in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on
Patna High Court CR. MISC. No.40755 of 2024(2) dt.02-09-2024 3/3 anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil), P.S. Case No. 703/2021 subject to condition as laid down under Section 438(2) of the Cr.P.C.
