JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-08-2023 It appears that vide order dated 28.09.2022, the petitioner was granted provisional bail for his treatment for a period of three months and thereafter he was directed to surrender and file surrender certificate before next date of hearing.

It is submitted by learned counsel for the petitioner that in pursuance to the direction of this Court, he made several attempts to contact the petitioner but the petitioner could not be contacted. Now he has no information about the whereabouts of

It appears that vide order dated 05.07.2023, a report was called for from the Court below as to whether petitioner has surrendered or not. In pursuance to the direction of this Court, the report has been received and it has been kept at Flag-D.

The report of learned 10th Additional District & Sessions Judge, Purnea dated 15.07.2023 suggests that petitioner has not surrendered, hence, his bail bonds has been cancelled on 01.02.2023 and nonbailable warrants of arrest has already been issued against him on 06.02.2023.

In that view of the matter, the provisional bail granted to the petitioner vide order dated 28.09.2022 is hereby cancelled.

The Superintendent of Police, Purnea is directed to take necessary steps for arrest of the petitioner and submit the compliance report to this Court.
