This bail petition is dismissed as withdrawn, with respect to petitioner nos. 1 and 2.

Heard learned counsel appearing on behalf of petitioner nos. 3 and 4, and the State.

Petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.39050 of 2023(2) dt.07-07-2023 2/3 registered for the offence punishable under Sections 498(A), 304(B), 120, 34 of the Indian Penal Code.

It is a case of Dowry death.

As per the prosecution case, petitioners along with other family members committed torture on the informant's daughter(deceased) due to non-fulfilment of dowry demand. Petitioner no. 3 is the devar and the petitioner no. 4 is the nanad of deceased.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that the petitioners are separate in mess and property and have got no concern with the alleged occurrence. Thrust of allegation is against the husband of the informant's daughter who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner nos. 3 and 4, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM-Kaimur at Bhabua in connection with Bhagwanpur P.S. Case No. 12 of

Patna High Court CR. MISC. No.39050 of 2023(2) dt.07-07-2023 3/3 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
