The present application has been filed for cancellation of bail, granted to opposite party no. 2 being the husband of the petitioner-complainant vide order dated 29.01.2014 passed in Criminal Miscellaneous No.1105/2014 in connection with Complaint Case No.C1-113/2011, pending in the Court of learned SDJM, Vaishali at Hajipur wherein process has been directed to be issued after cognizance being taken under sections 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.

It is submitted by learned counsel that opposite party no.2 was granted bail on 29.01.2014 considering the period

Patna High Court Cr.Misc. No.29071 of 2014 (2) dt.26-10-2016 2/2 under custody and readiness to keep the petitioner with dignity and honour but the opposite party no.2 mentioned wrong date of custody and failed to comply the undertaking to keep the petitioner with dignity.

Considering the nature of accusation and there is nothing on record to suggest that opposite party no.2 has misused the privilege of bail, this court is not inclined to interfere. Accordingly, the present bail cancellation application stands dismissed.
