Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Tisiauta P.S. Case No. 06 of 2022 lodged under Sections 363, 366(A)/34 of the I.P.C.

As per the prosecution case, the allegation has been made by the informant that her sister was kidnapped by the petitioner in which 4 named persons and 2-4 unknown persons were made accused including the present petitioner. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel submits that antecedent of the petitioner is clean and he is in

Patna High Court CR. MISC. No.36017 of 2022(3) dt.16-11-2022 2/2 custody since 18.01.2022. He further submits that alleged victim has been recovered and in her statement under Section 164 of Cr.P.C. she has not made any allegation of commission of crime against the present petitioner rather he submits that she went to Delhi by her own.

Learned counsel for the State opposes the prayer for bail and submits that from the case diary, it transpires that the petitioner and the alleged victim has solemnized marriage. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hajipur at Vaishali in connection with Tisiauta P.S. Case No. 06 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
