2. The petitioner apprehends his arrest in connection with Jandaha P.S. Case No. 101 of 2025 for the offence registered under Sections 80, 238, 3(5) of B.N.S., 2023 lodged on 10.03.2025 by the informant Urmila Devi.

As per the prosecution story, the informant alleged that the deceased (Urmila Devi) was married with Sanjeev Das, but was tortured for dowry and on 09.03.2025, he came to know that she has been killed and the mortal remains consigned to flame, those responsible for death were not present in the home. This led to the FIR.

4. Learned counsel for the petitioner submits that the subsequent story remains unfolded that her husband, Sanjeev

This petitioner is neither the family member nor the relative rather a villager and his name may have been dragged alleging that he has participated in the last rites. He is 75 years old having no criminal antecedent.

5. Learned APP for the State, on the other hand, opposes the prayer for anticipatory bail and submits that in the FIR, he is a named accused person.

Considering the submissions of the parties as also that a catagorical statement has been made that the petitioner has no relationship with the family members of the accused, he is a villager and no direct role has been attributed to him, he is 75 years of age having no criminal antecedent, in that background, this Court is inclined to grant him the anticipatory bail with conditions.

7. Let the petitioner in the event of arrest or surrnender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubJudge-VIII-cum-A.C.J.M.-VII, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 101 of 2025 subject to condition as

Patna High Court CR. MISC. No.34597 of 2025(2) dt.21-05-2025 3/3 laid down under Section 438 (2) of the Cr.P.C. (i) one of the bailor should be the family members/relatives of the petitioner, who shall provide official document to show is bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark attendance;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (Rajiv Roy, J) priyanka/- U T
