JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 379/411of the Indian Penal Code.

As per the prosecution case, petitioner was apprehended on the spot while trying to commit theft of mobile phone and cash of the informant from the bridge construction site. Learned counsel for the petitioner submits that the petitioner is in fact a labourer and at the relevant time he demanded his wages upon which the informant asked him to come next day. However, a hot discussion took place and informant assaulted him and handed him to the police with false allegation of theft. He is in custody since 16.2.2020. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.45199 of 2021(2) dt.03-11-2021 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Araria in Jokihat Mahalgaon Police Station Case No. 50 of 2020.
