The petitioner seeks bail in a case under Section 20, 22, 23 and 24 of N.D.P.S. Act.
From the Tanga of petitioner 64 kg. Ganja was recovered.
It is submitted that some passenger put Ganja on the Tanga of the petitioner and on seeing the police that passenger fled away. The petitioner is in jail since 05.03.2013. It appears that no passenger was found near the Tanga of petitioner. From the possession of petitioner 64 kg. Ganja was recovered.
Patna High Court Cr.Misc. No.33294 of 2015 (2) dt.19-08-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. Since the petitioner is in jail since 05.03.2013, the learned trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order. The Superintendent of Police, East Champaran, Motihari is directed to ensure attendance of all the witnesses during the course of trial so that the trial must conclude within nine months. If the trial is not concluded within nine months, the petitioner may renew his prayer for bail.
