Petitioners seek bail in connection with Vishnupad P.S. Case No. 219 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to previous enmity. The allegations levelled are general and omnibus in nature and there is nothing specific

Patna High Court CR. MISC. No.38401 of 2019(4) dt.13-09-2019 2/2 alleged against these petitioners. Parties are agnates. The alleged injury is not on the vital part of the body, and as such, no offence under section 307 I.P.C. is made out against these petitioners. Similarly situated co-accused has been granted bail by the learned Court below vide Annexure-2. Petitioners are in custody since 26.02.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 219 of 2018.
