JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-08-2015 Heard the learned counsel for the petitioner, the Special P.P. and the informant.

The petitioner seeks bail in a case registered for the offence punishable under Sections 323, 341, 379, 384, 504/34 of the Indian Penal Code and Section 3 (i) (ix) of SC/ST (Prevention of Atrocities) Act.

The allegation is of demanding extortion, making assault and abusing by calling caste name.

It is submitted that there is dispute between both the parties. The petitioner has filed complaint case no.2933 of 2013 against the sons of the informant and as a retaliation, the informant has filed the present case. In similar facts and circumstances, the co-accused Megnath Singh @ Megnith Singh and Lakshmi Singh

Patna High Court Cr.Misc. No.33365 of 2015 (2) dt.21-08-2015 2/2 have been granted anticipatory bail vide Cr. Misc. No.30385/2015. Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in SC/ST P.S. Case No.14 of 2015 with the following conditions :

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
