JUSTICE MADHURESH PRASAD ORAL ORDER 16-08-2022 The writ petition has been filed seeking following relief:- "For issuance of appropriate writ/writs, order/orders, direction/directions in the nature of mandamus for commanding the respondents to make payment of Rs. 840686/- (Eight Lac Forty Thousand, Six Hundred Eighty Six) with the statutory interest which is lying due with the respondent Zila Parishad from June 2006 till the date of the superannuation of the petitioner on 30.11.2015 and for any relief or reliefs for which the petitioner is legally entitled in the facts and circumstances of this case."

It is submitted by the petitioner's counsel that

Patna High Court CWJC No.347 of 2018(5) dt.16-08-2022 2/2 issue is now covered by decision of this Court in the case of Laxmi Narayan Singh V. State of Bihar & Ors. in CWJC No.7812 of 2005. Record, however, reveals relying upon the said judgment, petitioner has now approached the Authority.

The application is disposed of with liberty to the petitioner to approach the Authority concerned claiming benefits under the said judgment. Needless to say that the Authority would be under a legal obligation to consider the same in accordance with law preferably within a period of eight weeks from the date of receipt/production of a copy of this order along with the petitioner's representation.

It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim.
