10.12.2015 Heard learned counsel for the Petitioner and the State.

This revision application has been filed for setting aside the judgment and order dated 21.05.2015 passed by the 1st Additional Sessions Judge, Banka in Cr. Appeal (Juvenile) No. 12 of 2015, by which he has affirmed the order dated 09.04.2015 passed by the Juvenile Justice Board, Banka, by which he has refused to release the Petitioner in Amarpur P.S. Case No. 32 of 2015 (G.R. No. 162 of 2015).

It appears from the Report of the Principal Magistrate, Juvenile Justice Board dated 09.10.2015 that one witness has already been examined. In view of such, when the inquiry is on I do not wish to release the Petitioner.

The Application stands dismissed.

Patna High Court CR. REV. No.597 of 2015 (5) dt.10-12-2015 The Principal Magistrate, Juvenile Justice Board, Banka is directed to expedite the enquiry and conclude the same positively within a period of nine months from the date of receipt of this order for which reason he is directed to send a list of the witnesses fixing specific dates for prompt production of the witnesses along with a copy of this order, to the Superintendent of Police, Banka, and the Superintendent of Police, Banka is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
