JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468, 471 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have purchased a land fraudulently, which is recorded in the name of mother of complainant, in connivance with other accused persons.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that on the basis of Jamabandi petitioner has purchased the land from the land owner, Puran Singh, and the land owner also filed petition before the Circle Officer

Patna High Court CR. MISC. No.44835 of 2021(7) dt.27-06-2022 2/2 regarding land possession certificate and after enquiry the Circle Officer issued the certificate. Petitioner purchased the land from Puran Singh after certifying all the documents issued by the authorities. At best the dispute is of civil nature. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail bail.

Considering the facts of the case and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of four weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XI, Saran at Chapra in connection with Complaint case No. 343/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
