2. By way of this writ petition, the petitioner has challenged the notice dated 17.05.2023 issued by the Circle Officer, Bihta, Patna.

3. The petitioner is permitted to withdraw this application to file an appeal before the District Magistrate, Patna within thirty days from today challenging the final order passed by the Circle Officer, Bihta under Bihar Public Land Encroachment Act, 1956.

4. If such an appeal is filed before the District

Patna High Court CWJC No.8362 of 2023(4) dt.15-01-2024 2/2 Magistrate, Patna then the same shall be decided by the Collector, Patna on merits.

5. With the aforesaid directions, this application is disposed of.
