JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The contention on behalf of the petitioners is that the victim was in love with co-accused, Bipin Kumar and as a matter of fact, she eloped with co-accused, Bipin Kumar and got solemnized her marriage, which is evident from perusal of Annexure-4 to the petition.
The statement of victim has not been recorded as yet either u/S 161 of the Cr. P.C. or 164 of the Cr.P.C. but admittedly, petitioner Nos. 1 & 2 are full brothers whereas; petitioner No. 3 happens to be cousin of co-
Patna High Court Cr.Misc. No.33156 of 2015 (2) dt.18-08-2015 2/2 accused, Bipin Kumar.
Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bhawanipur P.S. Case No. 132 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Purnea.
