2. The petitioner is apprehending his arrest in connection Darauli P.S. Case No. 137 of 2024, F.I.R. dated 15.05.2024 for the offences punishable under Sections 376, 379, 323 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. According to prosecution case, the petitioner is sexually harassing the informant.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the
Patna High Court CR. MISC. No.35753 of 2025(2) dt.18-06-2025 2/2 petitioner has not committed any offences as alleged in the F.I.R.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R./Complaint Petition, it transpires that the petitioner was sexually harassing the informant on the pretext of the marriage. He further submits that the statement of the victim was recorded under Section 202 of the Cr.P.C. in which she has fully supported the case of the prosecution.
6. Considering the aforesaid facts, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Darauli P.S. Case No. 137 of 2024 pending in the court of C.J.M., Siwan.
7. Prayer is refused.
