Petitioner seeks regular bail in a case registered for the offence punishable under Section 392/397/411 of the Indian Penal Code.

As per the prosecution case, four miscreants riding on two motor cycles intercepted the informant and snatched two mobiles, ATM card etc. on the point of pistol and fled away. This petitioner and co-accused, Chandan Paswan were apprehended on the spot. Petitioner was duly identified and some looted money has been recovered from his house. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.45204 of 2021(3) dt.04-01-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. As a matter of fact petitioner was returning from his sister's village by tempo and only on suspicion he has been made accused in this case by the police. Petitioner is in custody since 11.11.2020 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rajeev Kumar, Judicial Magistrate-I, Begusarai in connection with Muffasil PS case No.574/2020.
