2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 317 (5) , 318 ( 4 )and 3(5) and Section 30(a) , 32 (1) , 41 (1) of the Bihar Prohibition and Excise Act.
3 . It is alleged that 4458.36 liters illicit liquor was recovered from the seized truck .
4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case . Petitioner is neither owner nor driver of the seized truck . The name of the petitioner transpired on the basis of secret information . Nothing has been recovered from the conscious possession of petitioner and has got no concern with the alleged
Patna High Court CR. MISC. No.34102 of 2025(3) dt.18-07-2025 2/2 occurrence . Charge sheet has already been submitted. Petitioner is in custody since 23.04.2025 .
5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of special Excise Court No. II cum Additional District and session Judge , Vaishali at Hajipur in connection with Mahua P. S. Case No. 1471 of 2024 .
