Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner, who is in custody since 29.09.2020, seeks regular bail in connection with S. Tr. No. 126 of 2021 arising out of Hisua P.S. Case No. 47 of 1998 dated 05.06.1998 registered for offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
Allegation against the petitioner is that for non fulfillment of demand of dowry petitioner has committed murder of his wife. Petitioner remained absconding and has surrendered on 29.09.2020.
Taking into consideration the nature of allegation
Patna High Court CR. MISC. No.45325 of 2021(4) dt.06-04-2022 2/2 made in the FIR against the petitioner as well as conduct of the petitioner, who remained absconding after committing murder of his wife, I am not inclined to enlarge the petitioner on bail. However, the learned trial Court is directed to conclude the trial expeditiously well within a period of twelve months.
If no substantial progress takes place in conduct of trial, the petitioner, if so advised, may renew his prayer for bail after the aforesaid period.
