2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Kesariya P.S. Case No. 375 of 2024 registered for the offences punishable under Sections 87, 3(5) of BNS.

3. As per FIR, the daughter of informant aged about 18 years was found missing since 12.11.2023. Informant raised her suspicion being mother that the petitioner alongwith other named co-accused person might be involved in missing/ kidnapping of her daughter.

4. It is submitted by learned counsel appearing on behalf of the petitioner that admittedly the victim was major and after recovery she stated that she went to Chennai with coaccused Prem Kumar, where they lived together for two months and thereafter solemnized marriage with him. It is pointed out that as the main co-accused was from paternal village of this

Patna High Court CR. MISC. No.36625 of 2025(4) dt.22-01-2026 2/2 petitioner, she only act like a bridge for communication between the daughter of informant and Prem Kumar who were in love. While concluding argument, it is submitted that petitioner is a lady of clean antecedent.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as victim prima-facie being major solemnized marriage with Prem Kumar, coupled with the fact that petitioner is a lady of clean antecedent, accordingly petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari /concerned Court, where the case is pending in connection with Kesariya P.S. Case No. 375 of 2024, subject to the conditions as laid down under Section 482(2) of BNSS.
