JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, confessional statement of co-accused Pintu Kumar was recorded and the aforesaid co-accused disclosed the name of the petitioner and prior to that some call details of the mobile of Rahul Sharma and Pintu Sharma were collected and it was detected that the aforesaid Rahul Sharma and Pintu Sharma were in constant touch of the petitioner. Moreover, except the confessional statement of the aforesaid co-accused as well as above stated call details and criminal antecedent of the petitioner, there is nothing against the petitioner. Petitioner is in jail custody

Patna High Court Cr.Misc. No.32301 of 2015 (2) dt.17-08-2015 2/2 since 22.04.2015 but up till now investigating agency did not take pain to put the petitioner on T.I.P.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad ( T) P.S.Case No. 95 of 2015.
