2. The petitioner is apprehending arrest in connection with Nayagaon P.S. Case No. 102 of 2024 lodged on 10.12.2024, for the offence punishable under Sections 126(2), 121(1), 352, 351(2), 303(2) & 132 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against the sole petitioner. It has been alleged in the FIR that the petitioner has assaulted the informant by fist on his stomach and also snatched Rs.5,300/- cash and golden chain from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that both the parties are well known to each other. Counsel submits that the petitioner has lodged a FIR against the informant and others bearing Nayagaon P.S. Case No.95 of 2024 on 24.11.2024 due to the reason that the informant and other accused persons assaulted the petitioner and only due to save their skin, informant has lodged the present case against the petitioner. Counsel further submits that the petitioner has no criminal antecedent.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that only due to apprehension, petitioner is not appearing before the Investigating Officer and the petitioner is not cooperating in the investigation and that is why the investigation of this case is still pending.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of Chief Judicial Magistrate,

Case No. 102 of 2024, subject to the conditions as laid down U/s 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with further condition that the petitioner shall appear before the concerned police station after every 15 days which shall continue for 2 years.
