The petitioner seeks bail in a case registered for the offences punishable under sections 406, 409, 420/34 of the Indian Penal Code.

The petitioner is said to have lifted paddy but he did not hand over rice after milling the same and thereby the petitioner is alleged to have misappropriated rice worth approximately Rs.67 lacs.

Mr. N. K. Agrawal, learned Senior Counsel appearing for the petitioner, submits that after institution of the case, the petitioner has already deposited approximately rupees seven lacs and the petitioner is ready to deposit the remaining

Patna High Court Cr.Misc. No.32382 of 2015 (2) dt.18-08-2015 amount out of 15% of the total outstanding amount out of which he has already deposited rupees seven lacs. The petitioner is in jail since 09.06.2015.

Considering the facts aforesaid, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sitamarhi in connection with Dumara P.S. Case No. 91 of 2015.
