JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is accused in connection with Sessions Trial No. 195 of 2013 arising out of Puraini P.S. Case No. 126 of 2012 registered under Sections 302/34 of the I.P.C. and 27 of the Arms Act pending in the Court of Addl. Sessions Judge, Adhoc-II, Madhepura.

Learned counsel appearing on behalf of the petitioner submits that earlier prayer of the petitioner for bail was rejected twice by the Court vide Cr. Misc. Nos. 31250 of 2013 and 47419 of 2014 orders dated 06.02.2014 and 10.12.2014 respectively. It is also submitted that petitioner, having no criminal antecedent, is in custody since 19.08.2013.

Patna High Court Cr.Misc. No.33479 of 2015 (2) dt.22-07-2015 2/2 Admittedly, prayer of the petitioner was earlier rejected on merit by this Court taking into consideration the nature of allegation of firing by this petitioner and co-accused Jai Kishore Sharma at the deceased.

In such circumstances, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, trial Court is directed to conclude the trial expeditiously.
