The petitioner is languishing in custody since 11.12.2014 in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
The prosecution case is that the brother of the informant went missing since 13.05.2014 when the FIR was lodged against Mushan Mian, Mokir Mian, Bokan Mian, Ibrar Mian, Ganauri Mian and Najam Mian. The petitioner was not named in the FIR. His name transpired during investigation when the witness Anwa Devi, Krsihnadeo Yadav and the victim named the petitioner. The victim suggested that along with others the petitioner abducted the victim took him in the hills but after few hours after offering food
Patna High Court Cr.Misc. No.33663 of 2015 (2) dt.19-08-2015 2/2 released him.
It has been submitted by the learned counsel for the petitioner that the petitioner has not been named in the F.I.R. and a Co-ordinate Bench of this Court has already granted privilege of bail to similarly situated person in Cr. Misc. No. 9693of 2015 dated 06.07.2015.
Under such circumstance, let the petitioner, namely, Gore Lal Tanti be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class,, Jamui in connection with Khaira P.S. Case No. 74/2014, on a condition that the petitioner shall appear in the Court below. If he fails to appear before the Court below on two consecutive dates and is again found involved in the similar nature of cases, as he is accused in a number of other cases, the bail bond will be liable to be cancelled by the learned Court below.
